§ 70.01   STATE AUTHORITY.

This title is adopted and written under authority of I.C. 9-21-1-2.

§ 70.02   DISPOSITION OF FINES.

All fines assessed for violations of this title upon adoption by local authority will be deposited into the General Fund.

§ 70.03   AUTHORITY TO ADOPT ADDITIONAL REGULATIONS.

The local authority has the power to adopt by ordinance additional traffic regulations and stipulate additions of state statues with respect to streets and highways under the authority's jurisdictions. An ordinance adopted may not conflict with or duplicate a state statue.

§ 70.04   NON-PAYMENT OF FINES; SUSPENSION OF DRIVING PRIVILEGES.

Non-payment of fines may result in a state suspension of driving privileges if requested by the local court.

§ 70.05   TRAFFIC CONTROL DEVICES.

The local authority shall place and maintain traffic control devices upon highways under the authority's jurisdiction, not including state highways, the authority considers necessary to indicate and to carry out enforcement of this title or to regulate, warn or guide traffic. All traffic control devices erected under this title must conform to the state manual and specifications.

§ 70.06   WARNING SIGNS.

Warning signs (that is, children playing, school bus stop, and the like) may be erected and/or placed in areas that are applicable. However, the signs are meant as warnings and are not enforceable under this title.

§ 70.07   DECLARED EMERGENCIES.

(A)   When unforeseen emergencies occur, town employees with consultation with the local law enforcement agency, may have to detour or re-route traffic. During these situations, traffic flow interruptions will be kept to a minimum and barricades and signs will be placed so routes and hazards are well marked. If flagpersons are utilized, they act the same as traffic control devices or signals and violators will be cited and are subject to fines and costs incurred herein.

(B)   Because snow fall is unpredictable, and the local authority is responsible for snow removal, the Town Council President may declare a snow emergency for streets under local authority and jurisdiction. If so declared, town street crews and the local law enforcement agency will try to contact the owners of all vehicles impeding snow removal and have them removed. If unable to contact the owners, or if the owners refuse to remove the vehicle(s) from the street, the vehicle(s) are subject to removal (towing) and costs incurred will be assessed.

§ 70.08   TOWING COSTS.

Towing a vehicle shall have a maximum cost of $100 and a minimum charge of $50, and $10 per day storage and a $15 inventory and processing fee. All fines must be paid and a receipt presented prior to release of the owners vehicle or property.

§ 70.99   PENALTY.

Any violation incurred under this title, unless otherwise provided, will be considered a Class C infraction and fined not more than $500 nor less than $5. Court cost will also be assessed for any violation of this section.

CHAPTER 71:   TRAFFIC RULES

71.01       Speed limits
71.02 Weight limitations

 

§ 71.01   SPEED LIMITS.

(A)   The Town Council, herein known as local authority in the authority's jurisdiction, determines on the basis of an engineering and traffic investigation the legal prima facia speed for an urban district and alleys in accordance with the Indiana Code of 30 miles per hour for streets and 15 miles per hour for alleys, is greater than reasonable and unsafe under the conditions found to exist on the streets and highways of the town.

(B)   Because the minimum width of streets and alleys within the city limits and because of the close proximity of houses and lack of pedestrian walkways and sidewalks, the local authority deems it necessary to exercise its authority given in accordance with I.C. 9-21-5-6(a)(1) and I.C. 9-21-5-6(a)(4) and alter the legal prima facia speed limits within the town limits:

(1)   The legal and safe maximum speed on all streets within the town limits is herein set at 25 miles per hour.

(2)   The legal and safe maximum speed on all alleys is herein set at ten miles per hour.

(3)   Exception to the legal and safe maximum speed is East and West Broadway, more commonly known as SR 218, which will remain as posted. (I.C. 9-21-5-6(d))

§ 71.02   WEIGHT LIMITATIONS.

No vehicle shall be operated or moved over the bridge on and by which the public highway known as North Elm Street, crosses over that formerly known as the Pennsylvania Railroad Company lessee of and operating the railroad of the Pittsburgh, Cincinnati, Chicago and St. Louis Railroad Company, the gross weight of which vehicle, including any load thereon, is in excess of 20,000 pounds (ten tons), which gross weight has been determined to be the maximum load which can, with safety, be carried by said bridge and sustain without serious damage.

§ 72.01   PARALLEL AND ANGLE PARKING.

All parking on streets within the town limits will be in accordance with I.C. 9-21-16-7, which states: A vehicle stopped or parked upon a roadway where there is an adjacent curb shall be stopped or parked with the right hand wheels of the vehicle parallel with and within 12 inches of the right hand curb. Angle parking or straight-in parking will be permitted under this chapter only in private or public parking lots located within the town limits.

§ 72.02   DOUBLE PARKING.

Double parking of delivery vehicles on East and West Broadway (SR 218) within the business district will be allowed if:

(A)   It does not impede local thru traffic;

(B)   It does not present a safety or road hazard;

(C)   It does not block any private drive or cross-street intersection.

§ 72.03   TIMED PARKING.

Two parking spaces on the north side of East Broadway, in front of the US Post Office, are designated as timed parking. Timed parking spaces will be of 15 minute duration during the hours of 7:30 a.m. through 5:00 p.m., Monday thru Friday. During non-timed parking hours, parking spaces will be of unlimited duration. Vehicles parked longer than the specified period of time will be cited and fined under the guidance of this title.

§ 72.04   SEMI (TRACTOR/TRAILER) PARKING.

Semi (tractor/trailer) parking is not permitted on any local street in the corporate limits.

§ 72.05   STOPPING OR PARKING IN ALLEYS.

No vehicle will be stopped or parked in any alley within the town limits.

§ 72.06   LOCATIONS WHERE STOPPING OR PARKING PROHIBITED.

No person shall stop or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer, in any of the following places:

(A)   On a sidewalk;

(B)   In front of a public or private driveway;

(C)   Within an intersection;

(D)   Within 15 feet of a fire hydrant;

(E)   On a crosswalk;

(F)   Within 20 feet of a crosswalk at an intersection;

(G)   Within 30 feet of any flashing beacon, stop sign, or traffic-control signal located at the side of a street;

(H)   Within 50 feet of the nearest rail of a railroad crossing;

(I)   Within 20 feet of the driveway entrance to any fire station, and on the side of a street opposite the entrance to any fire station within 75 feet of said entrance, when properly signposted;

(J)   Alongside or opposite any street excavation or obstruction when to do so would obstruct traffic;

(K)   On the roadway side of any vehicle stopped or parked at the edge or curb of a street;

(L)   Upon any bridge or other elevated structure upon a street;

(M)   At any place where official signs prohibit stopping or parking; and no person shall move a vehicle into any such prohibited area or away from a curb or street line such distance as is unlawful.

§ 73.01   EQUIPMENT.

(A)   Bicycles must be equipped with lamps (lights) if operated on streets under local authority from one-half hour after sunset until one-half hour before sunrise.

(B)   Lights (lamps) on the rear must be red and visible for a distance of 500 feet or a red reflector of the same visibility.

(C)   Lights (lamps) on the front exhibit a white light visible from a distance of at least 500 feet.

§ 73.02   OPERATION.

All bicycles must be operated under the "Rules of the Road" and are subject to the same traffic rules and regulations as motorized vehicles.

§ 73.99   PENALTY.

Any person found violating this chapter is subject to a citation and a $5 fine. Repeat violations may be subject to confiscation of the bicycle.
